The lawyer for Calgary's latest murder suspect is waiting for the Crown to open

A lawyer for the latest suspect in the Calgary death said Tuesday the Crown must disclose the next step in the case.

Defense attorney Allan Fay appeared briefly last week on behalf of Ryan Kinoshita in Calgary court in connection with the murder of the defendant's homeowner.

Kinoshita, 29, charged with second-degree murder in the April 8 stabbing death of Joel Aaron Clark, appeared in court via closed-circuit television from a Calgary detention center.

Fay asked Judge Catherine Skene to adjourn the case until April 24.

Outside court, Fay said he needed to get information from appointed prosecutor Scott Wilson about the charges against his client to determine his next move.

“I'm only staying on as his counsel, so I need to open the Crown file,” he said.

“Once I disclose that information, I can review it with my client and discuss the next step.”

One of the steps Fay will have to consider is whether he will seek bail for his client pending trial or when he might order a preliminary investigation.

Clark, 46, was stabbed to death at his home on Prestwick Terrace SE, police said.

“Investigators believe the fatal attack was the result of an argument between the victim and the accused,” police said in a news release last week.

Derek Henson, a longtime friend of Clark's, said his death was an “absolute tragedy” but said he believes his friend will be remembered for the good he did for those around him.

“The memory of him, who he was and everything that he did, I think will live on in all the people that he helped and impacted and changed,” said Henson, who said he knew Clark for 30 years. Dating as young adults in Victoria.
