MPI is suing the City of Winnipeg, a contractor, over a sewer well that caused an SUV to overturn.

Manitoba's public insurer is suing the City of Winnipeg and a snow removal contractor after an alleged collision with a falling sewer cover two years ago.

Manitoba Public Insurance claims the blade or bucket of a snowplow owned by SM Ventures Inc. was dislodged from a sewer cover while plowing in a residential area north of Winnipeg on February 10, 2022.

The snowplow operator — an unnamed man who is a defendant in the lawsuit — then called the city and said he or a city employee who came to check on the situation had put it back in a way that would allow the cover to be easier. passing vehicles were pulled out of the sewer well.'

Soon after, another vehicle removed the hood, the lawsuit alleges, and then a 2018 Ford EcoSport Titanium struck it and flipped onto its side.

MPI filed the lawsuit on January 31.

MPI alleges that the person operating the snow plow was negligent by carelessly, negligently and/or dangerously, removing the cover and failing to ensure that the site was not left in a dangerous condition, among other details. MPI claims that SM Ventures is responsible.

The city, among other violations, allowed or caused the danger by failing to ensure the site was safe, according to the lawsuit.

MPI is seeking more than $23,000 in court costs.

None of the claims have been tested in court.
